Filing a Medical Malpractice Claim for a Birth-Related Injury

May 13, 2022 Posted by Oliver Nelson III Blog/News

Childbirth is a magical and exciting time for the family, but injuries during birth can be devastating. If health care professionals fail to provide reasonable care or practice negligence, the mother and child could be in danger. Magna Law’s medical malpractice attorneys in Minneapolis will ensure that a hospital will be held liable if birth injuries occur to you or your child.

What are Birth-Related Injuries?

This occurs when the child or mother is injured during delivery or pregnancy. There are various ways in which a hospital can commit birth-related injuries, which include the following:

  • Wrongful birth: This happens when the parents would have made the decision to avoid or end a pregnancy if they were informed about birth defects. The claim can be made if the doctor or hospital was negligent in genetic testing before the child was conceived or if they fail to detect physical or mental impairments during the pregnancy’s early stages.
  • Wrongful pregnancy: This occurs when the parents fail in their attempt to end or avoid a pregnancy. A claim can be made if their efforts to avoid pregnancy — such as abortion, pregnancy testing, or sterilization — failed as a result of negligence by the doctor or medical staff.
  • Injuries to the mother or infant: This rarely happens but may occur when the doctor negligently fails to monitor the baby’s oxygen intake or fails to control excessive blood loss. Moreover, the parents can also sue for emotional suffering and pain they experience as a result of these accidents.

Filing a Medical Malpractice Claim

If you or your child were injured as a result of negligence during your birthing process, you could file a claim to get the compensation you deserve. At Magna Law, we’ll work hard to prove that medical professionals were negligent, resulting in the injury of your child.
