Minnesota statutes §573.02 states wrongful death is “an incident caused by the wrongful act or omission of any person or corporation.” Some examples of those liable for wrongful death include:

  • A negligent employer
  • A reckless or intoxicated driver

  • A doctor and/or hospital that has given a wrong diagnosis, provided improper treatment, or made surgical errors

In Minnesota, the victim’s children, parents, grandparents, siblings, or spouse may file a wrongful death suit.

Minnesota law compels the deceased’s surviving spouse or next of kin to petition the court to appoint a trustee. The trustee will file the lawsuit and oversee the distribution of any damages awarded. Only the trustee may file the wrongful death suit.
