What Is Considered a Birth Injury?

April 5, 2022 Posted by Oliver Nelson III Blog/News

Any injury to an infant or newborn child is hurtful and often devastating, depending on its severity and long term consequences. When such an injury happens, the parents suffer along with their child and part of the hardship they may face is often financial. Our birth injury lawyers at Magna Law Firm are able to investigate your birth injury claim and help you obtain the compensation you and your family are owed and need to cover medical care expenses for your baby and more.

What is a Birth Injury?

A birth injury is the injury an unborn infant or newborn baby sustains in some manner as a result the medical negligence or malpractice of a doctor or other medical professional. This can include an array of injuries, with each one potentially resulting in debilitating conditions or disabilities. Some examples of newborn birth injuries include:

  • Erb’s palsy or cerebral palsy
  • Shoulder dystocia
  • Brachial palsy
  • Facial paralysis
  • Bruising or forceps marks
  • Subconjunctival or intracranial hemorrhages
  • Diabetic retinopathy, potentially leading to loss of vision
  • Cephalohematoma
  • Subgaleal hemorrhage
  • Perinatal asphyxia
  • Fractures

Some birth injuries are caused by oxygen deprivation of the infant during delivery. Prolonged oxygen deprivation can prevent the brain from developing and even reverse the process of development. This can result in brain damage.

When these injuries are caused by medical professionals through negligence or willful misconduct, the law allows those responsible to be held accountable.

Causes of Birth Injuries

A medical professional can cause a birth injury through medical malpractice. This involves negligence in practice and the delivery of substandard care to the newborn, or the mother, or both.

In some cases, defective medical equipment can also cause birth injuries. In this case, the fault may rest with the manufacturer of the defective product and not the medical professional using the equipment. Medical devices may be defective and cause harm to an infant or mother due to their flawed design, manufacturing, advertising, or packaging.

If your baby sustained injuries due to the negligence of a medical professional, we are here to help you secure the compensation you deserve. To set up a free consultation about your birth injury case, give us a call today at 763.438.3032 or use our contact form to leave us a message.
